1. Agreement
By accessing or using Apogee Watcher (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. We may update these Terms from time to time; the “Last updated” date above will change, and continued use after changes constitutes acceptance where permitted by law.
2. The service
Apogee Watcher is a software-as-a-service platform for website performance monitoring and related features (including, where available, reporting, alerts, and team collaboration). Features and limits depend on your plan and what we make available in the product at any time.
3. Accounts
You are responsible for the accuracy of information you provide, for safeguarding your credentials, and for activity under your account. You must not misuse the Service (including attempting to probe, scan, or test vulnerabilities without our prior written consent, or interfering with other customers’ use).
4. Acceptable use
You will not use the Service in violation of applicable law, to infringe third-party rights, or to transmit unlawful or harmful content. We may suspend or terminate access if we reasonably believe there is a risk to the Service, to other users, or to third parties.
5. Subscriptions and fees
Fees, billing cycles, and taxes are as presented at checkout or in your order, unless otherwise agreed in writing. Failure to pay may result in suspension or termination of access. If you cancel, your access may continue until the end of the paid period, then end, unless we state otherwise.
6. Intellectual property
We retain all rights in the Service, software, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your plan. You retain rights in your content; you grant us the rights needed to operate the Service for you (e.g. hosting, processing, and displaying your data as you configure).

The Service may integrate with third-party APIs or services (for example Google PageSpeed Insights for tests). Those services are governed by their own terms and policies.
8. Disclaimers
The Service is provided “as is” and “as available” to the maximum extent permitted by law. We do not guarantee uninterrupted or error-free operation or that results (including scores or recommendations) will meet your business requirements.
9. Limitation of liability
To the maximum extent permitted by applicable law, Apogee Information Systems and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, unless mandatory law requires otherwise.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, risk to the Service, or as required by law. Provisions that by nature should survive (including limitations of liability, intellectual property, and governing law) will survive termination.
11. Governing law
These Terms are governed by the laws applicable in Luxembourg, without regard to conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise.

1. Data controller
Apogee Information Systems (“we”, “us”) is the controller for personal data processed in connection with this website and the Apogee Watcher service, unless we state otherwise (for example where we act strictly as a processor on behalf of a customer).

Production hosting for Apogee Watcher is located in data centres in the European Union. We may use subprocessors (including for infrastructure, email, or support) in the EU or elsewhere; where required, we rely on appropriate safeguards such as the EU Standard Contractual Clauses.

We use cookies and similar technologies as needed for the Service to function, for security, and to understand how our website is used. You can control cookies through your browser settings.
6. Analytics and third-party scripts
On this site and in the product we may load or use:
- Matomo — self-hosted web analytics (e.g.
analytics.apogee.gr) to measure visits and usage. - Microsoft Clarity — on production, for session insights and product/UX improvement (subject to Microsoft’s terms).
- Google reCAPTCHA — on forms such as sign-up, early access, or newsletter sign-up, to reduce spam (Google may process data as described in their policies).
- Google PageSpeed Insights — when you run tests, Google processes the requested URLs and related technical data under Google’s terms.
7. Retention
We retain personal data only as long as needed for the purposes above, including legal, accounting, or security requirements, and for backup and disaster recovery within defined limits.
