GENERAL REFERENCES
Parks — See Ch. 416.
The following words and phrases shall have the meaning ascribed to them:
ACTIVITY
Includes any athletic event, game or other organized assembly of persons for a common purpose in the parks of the City of Peekskill.
DIRECTOR
The Director of Human Services of the City of Peekskill. [1]
1936 ORDINANCE
The Ordinance to Regulate the Use of Public Parks in the Village (City) of Peekskill, New York, as amended, originally adopted May 26, 1936.[2]
PARK
A park, reservation, playground, recreation center or any other area in the City owned or used by the City and dedicated, devoted or used for active or passive recreation.
PERMIT
Written permission granted by the Director pursuant to the 1936 Ordinance and § C195 of the Charter of the City of Peekskill, as amended, which permission shall state the terms and conditions upon which same is granted, as to which permittee shall acknowledge its acceptance and agreement.
PERSON
Any individual or group of individuals acting in concert, a partnership, corporation, association or a legal entity.

Any activity proposed to be conducted in the parks which requires permission pursuant to the 1936 Ordinance shall be conducted only in the event that the Director shall issue a permit in accordance with the standards hereinafter provided.
The Director shall issue permits upon application where required and/or shall schedule activities in accordance with the following standards and subject to the 1936 Ordinance and any other applicable laws, ordinances, rules and regulations:
A. 
The conduct of the activity shall not substantially interrupt the safe and orderly movement of other traffic in the parks so as to adversely affect the activities in the park or the use of other park or private facilities.
B. 
The conduct of the activity shall not require the diversion of so great a number of police officers of the City to properly police the activity and the areas contiguous thereto as to prevent normal police protection to the City and to other scheduled activities.
C. 
The conduct of such activity will not require the diversion of ambulances so as to prevent normal ambulance service to the portions of the City other than that to be occupied by the proposed activity.
D. 
The concentration of persons, equipment, displays, etc., will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to the activity or other areas of the City.
E. 
The conduct of the activity will not interfere with the movement of fire-fighting equipment en route to a fire.
F. 
The conduct of the activity shall not be reasonably likely to cause injury to persons or property, to provoke disorderly conduct or create a disturbance.
G. 
The activity, when considered in conjunction with other activities proposed to be similarly scheduled, shall not overburden other City departments so as to prevent the rendering of services which are essential to the health, safety and welfare of the general public in the City of Peekskill.
