Mobile food trucks shall be permitted under the following conditions:
A. 
Location. Must operate only on private lots with written permission from the property owner. Operation on public streets or public property is strictly prohibited unless as part of a City-sponsored event.
B. 
Time limit. May operate no more than three consecutive calendar days in any thirty-day period, per location.
C. 
Affiliation requirement. Must be operated exclusively to support an existing brick-and-mortar food or beverage establishment located within City limits.
D. 
Distance restriction. Mobile food trucks must be located within 150 feet of the affiliated brick-and-mortar business unless otherwise approved for a City-sponsored event.
The following uses of mobile food trucks shall be exempt from the requirements of § 318-2, provided all activity occurs on private property and poses no public health or safety risks:
A. 
City-sponsored events. Food trucks participating in a City-sponsored event may operate with approval from the Main Street Director and City Administrator. These trucks are exempt from the affiliation and location requirements listed above for the duration of the event.
B. 
Promotional events. Non-food and beverage businesses, such as banks or retail stores, may host a mobile food truck on their private property for a one-day promotional event, provided the food truck is not operating independently for general public sales.
C. 
Private residential events. Residents may hire a mobile food truck for a private party or gathering where the food truck is not open to the general public for sales. No permit is required for such use.
A. 
Permit required. A temporary mobile food permit must be obtained for each use, unless otherwise exempted under § 318-3.
B. 
Application requirements. Each applicant must submit a completed application form and provide the following:
(1) 
Date(s) of operation.
(2) 
Name, address, and phone number of the mobile food truck owner and operator.
(3) 
Copy of current vehicle registration.
(4) 
Dimensions of the food truck (length and width).
(5) 
Copy of current business license.
(6) 
Copy of current Pennsylvania sales tax certificate.
(7) 
Proof of vehicle insurance.
(8) 
Proof of general business liability insurance.
(9) 
Copy of ServSafe or equivalent food safety certification.
(10) 
Letter of permission from the private property owner, if not the applicant.
(11) 
Site plan showing food truck placement, parking, and trash disposal.
(12) 
Signature of the applicant (and operator, if different) acknowledging that they have read and understand all of the terms and conditions of the chapter and swear to comply under penalty of law.
C. 
Approvals required. All applications must be reviewed and approved by both the Code Enforcement Officer and the Main Street Director.
D. 
Application fee. The permit fee shall be $50 per day, or $100 for three consecutive days. This fee may be changed from time-to-time and anytime by resolution.
A. 
Hours of operation:
(1) 
Sunday through Thursday: 8:00 a.m. to 9:00 p.m.
(2) 
Friday and Saturday: 8:00 a.m. to 10:00 p.m.
B. 
Time limit for parking. Mobile food trucks may not remain parked at any one location for more than 24 hours, regardless of sales activity. Trucks must be removed from the site daily unless part of a City-approved multi-day event.
C. 
Location and safety requirements:
(1) 
Trucks must be parked within 150 feet of the sponsoring brick-and-mortar business, unless exempted for a City event.
(2) 
Trucks may not block any building or parking lot ingress or egress.
(3) 
No power cords, cables, hoses, or equipment may extend across public sidewalks or City property.
(4) 
Generators are prohibited unless written approval is granted for a silent (low-noise) generator.
D. 
Utilities and waste:
(1) 
All trash and waste must be removed daily.
(2) 
No gray water, grease, or debris may be dumped or disposed of on-site.
(3) 
Waste containers must be on the truck or within five feet and maintained in a clean, sanitary condition.
E. 
Noise. Must comply with applicable City noise ordinances. Music or amplified sound is prohibited unless part of a permitted event.
F. 
Signage:
(1) 
Signage must be limited to permanent or magnetic signage affixed directly to the vehicle, and one sandwich board sign not exceeding six square feet per side.
(2) 
The sandwich board sign must:
(a) 
Be located within five feet of the truck.
(b) 
Not block sidewalks, pedestrian walkways, or ADA access.
(c) 
Not obstruct vehicular sight lines or driving sight triangles.
(3) 
No flashing lights, inflatable signs, or banners are allowed on the truck or surrounding area.
A. 
Violations of this chapter are subject to a fine of $500 per day of non-compliance.
B. 
Repeated violations may result in the revocation of mobile food truck privileges for up to 12 months.
If any section of this chapter is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
All ordinances or parts of ordinances inconsistent with this chapter are hereby repealed in their entirety.
