A. 
It shall be unlawful for persons from the ages of 15 years to and including 17 years old to be or remain in or upon any public street, alley or public commons in the City of Pittston at night after the hour of 11:00 p.m., unless such person is accompanied by a parent, guardian or other person having the legal custody of said minor person or whose employment makes it necessary to be upon said street, alleys or public commons at night after the hour of 11:00 p.m. This curfew will remain in effect until 6:00 a.m.
B. 
It shall be unlawful for persons 14 years of age and under to be or remain in or upon any public street, alley or public common in the City of Pittston at night after the time of 9:30 p.m., unless such person is accompanied by a parent, guardian or other person having the legal custody of said minor person. This curfew will remain in effect until 6:00 a.m.
The owner of any business establishment in the City of Pittston shall require persons of such ages as addressed in this chapter to leave their businesses with sufficient time to arrive at their homes if they are pedestrians. Businesses that repeatedly violate this section shall be cited under this chapter.
Any person violating any of the provisions of this chapter shall, upon conviction thereof in a summary proceeding before a Magisterial District Judge with jurisdiction over the City of Pittston, be sentenced to pay a fine of not more than $300, and costs, and/or imprisonment not to exceed 90 days. Each and every day upon which any person violates or continues to violate the provisions of this chapter shall constitute a separate offense.
