It shall be unlawful in this Township to sell or distribute alcoholic beverages otherwise than as provided in this article or the Alcoholic Beverage Law constituted by Chapter 1 of Title 33 of the Revised Statutes of the State of New Jersey and rules and regulations made pursuant thereto.

The Township Committee shall constitute the authority for the issuance of licenses hereunder.

A.
The annual fee for each plenary retail consumption license, commencing July 1 of each year, shall be $2,500.
B.
The annual fee for each plenary retail distribution license, commencing July 1 of each year, shall be $2,500.
C.
The annual fee for each club license, commencing July 1 of each year, shall be $188.
A.
No licensee shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverages in this Township on weekdays between the hours of 2:00 a.m. and 7:00 a.m. or on Sundays between the hours of 2:00 a.m. and 12:00 noon (2:00 a.m. to 10:00 a.m. for takeout sales only), excepting New Year's Day as hereinafter provided.

B.
No licensee shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of alcoholic beverages in this Township on New Year's Day, when it is a weekday, between the hours of 4:00 a.m. and 7:00 a.m. or on New Year's Day, when it is a Sunday, between the hours of 4:00 a.m. and 1:00 p.m.
During the hours that sales of alcoholic beverages are prohibited, no person shall be admitted to or permitted to remain upon the licensed premises except the licensee or bona fide employees of the licensee.

Any license issued pursuant to this article may be suspended or revoked for violation of any of the provisions of this article or for violation of any of the provisions of the Alcoholic Beverage Law[1] hereinbefore referred to or of any of the rules and regulations promulgated by the Director of the Division of Alcoholic Beverage Control as provided by law.

Any person who shall sell or distribute any alcoholic beverages without having complied with or in violation of any of the provisions of this article shall, upon conviction thereof, be subject to one or more of the following, in the discretion of the Judge before whom such conviction shall be had: a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days. The Township waives the additional fine for a violation of an ordinance within one year of a previous violation of the same ordinance provided in N.J.S.A. 40:49-5.
