Local Schedule PW, Retention Schedule for Records of Public Works and Other Government Services

(Third Edition, Effective June 30, 2026) - 13 TAC §7.127

Table of Contents


This schedule establishes mandatory minimum retention periods for records that are associated with public works and other government services. No local government office may dispose of a record listed in this schedule prior to the expiration of its retention period. A records control schedule of a local government may not set a retention period that is less than that established for the record in this schedule. Original paper records may be disposed of prior to the expiration of their minimum retention periods if they have been microfilmed or electronically stored pursuant to the provisions of the Local Government Code, Chapter 204 or Chapter 205, as applicable, and rules of the Texas State Library and Archives Commission adopted under those chapters. Actual disposal of such records by a local government is subject to the policies and procedures of its records management program.

Destruction of local government records contrary to the provisions of the Local Government Records Act of 1989 (Local Government Code, Chapters 201-205) and administrative rules adopted under Texas Government Code, Section 441.158, including this schedule, is a Class A misdemeanor and, under certain circumstances, a third-degree felony (Penal Code, Section 37.10).  Anyone destroying local government records without legal authorization may also be subject to criminal penalties and fines under the Public Information Act (Government Code, Chapter 552).

Introduction

Per Government Code, Section 441.158, the Texas State Library and Archives Commission shall issue records retention schedules for each type of local government, including a schedule for records common to all types of local government. For records for which a period is prescribed, the law provides that each schedule must state the retention period prescribed by federal or state law, rule of court, or regulation; for all other records, each schedule will prescribe a retention period, which have the same effect as if prescribed by law after the records retention schedule is adopted as a rule of the commission. The retention periods given in this schedule are required minimums. The commission also recommends them as appropriate maximum periods. If a federal or state statute or regulation specifies a longer retention period for any records series received, created, or maintained by a local government, the statute or regulation overrides this schedule.

Summary of Important Points

  • Retention periods listed in this schedule are required minimums. In situations where local governments may need to keep some of the records listed for longer periods, they should consult with appropriate internal staff.
     
  • Federal or state statutes or regulations requiring longer retention periods override retention periods listed in this schedule.
     
  • This schedule is format-neutral, meaning the record series and retention periods listed in this schedule apply to records in any medium. If records are stored electronically, they must remain available and accessible until the expiration of the retention period assigned by this schedule, along with any hardware or software required to access or read them. Electronic records may include e-mail, websites, electronic publications, or any other records in a machine-readable format. Paper or microfilm copies may be retained in lieu of electronic records.
     
  • The retention period for a record is in calendar years from the date of its creation, unless otherwise stated. The retention period applies only to an official record as distinct from convenience or working copies created for informational purposes. Where several copies are maintained, each local government should decide which shall be the official record and in which of its divisions or departments it will be maintained. Local governments, in their records management programs, should establish policies and procedures to provide for the systematic disposal of copies.
     
  • If a record described in this schedule is maintained in a bound volume of a type in which pages were not meant to be removed, the retention period, unless otherwise stated, applies from the date of last entry.
     
  • If two or more records listed in this schedule are maintained together by a local government and are not severable, the combined record must be retained for the longest retention period of all the component record series. 
     
  • Certain records listed in this schedule are assigned the retention period of AV (as long as administratively valuable). This retention period affords local governments the maximum amount of discretion in determining a specific retention period for the record described. Once a local government determines the appropriate specific retention period for the impacted records, they should document this retention period on the records control schedule of the local government (internal retention schedule) for consistent management and disposition.
     
  • A local government record whose retention period has expired may not be destroyed if any litigation, claim, negotiation, audit, public information request, administrative review, or other action involving the record is initiated; its destruction shall not occur until the completion of the action and the resolution of all issues that arise from it.
     
  • A local government record whose retention period expires during any litigation, claim, negotiation, audit, public information request, administrative review, or other action involving the record may not be destroyed until the completion of the action and the resolution of all issues that arise from it.
     
  • If a record is not listed on any schedule issued by the commission, it may be destroyed if the local government notifies the commission at least 10 days before destroying the record (Government Code, Section 441.095 and Section 441.169(3)).

Use of Asterisk (*)

The use of an asterisk in this edition of Local Schedule PW indicates that the record is either new to this edition, the retention period for the record has been changed, or substantive amendments have been made to the description or remarks concerning the record. An asterisk is not used to indicate minor amendments to grammar or punctuation.

RETENTION CODES: All numbers used with retention periods are expressed in years unless otherwise indicated.

AV        As Long as Administratively Valuable: The immediate purpose for which the record was created has been fulfilled and any subsequent need for the record to conduct the operations of the agency, if any, has been satisfied.

CE        Calendar Year End: December 31.

FE         Fiscal Year End: August 31 (or as applicable to local government, if different)

LA       Life of Asset: The record is retained until the disposition of the asset.

PM      Permanent: A record that possesses enduring legal, fiscal, or administrative value and must be preserved permanently by the local government.

US       Until Superseded: The record is replaced by an updated version. If the record is discontinued or is no longer required by law, the date of supersession is the date the decision to discontinue the record is made or the law takes effect. If the record relates to an employee, the date of supersession is the date of termination or the last date the record is needed with reference to the employee, as applicable.

PART 11: Public Broadcasting Records

Retention Notes:  a) The retention periods in this part are for the records of noncommercial AM or FM radio and television broadcasting stations owned and operated by a local government.

b) Throughout this part the Federal Communication Commission is referred to as the FCC.

c) It is an exception to the retention periods given in this part, that records having a substantial bearing on a matter which is the subject of a claim against the licensee, or relating to an FCC investigation or a complaint to the FCC of which the licensee has been advised, shall be retained until the licensee is notified in writing that the records may be discarded, or, if the matter is a private one, the claim has been satisfied or is barred by statutes of limitation. 
In addition, it is an exception to the retention period for item number PW5575-08 that logs involving communications incident to a disaster or which include communications incident to or involved in an investigation by the FCC and about which the licensee has been notified, shall be retained by the licensee until specifically authorized in writing by the FCC to destroy them.
